Smart4ce Website Terms and Conditions

These Terms and Conditions (“Terms”) apply to your use of smart4ce.com (the “Site”). The Site is operated by Automodo LLC d/b/a Smart4ce (“Smart4ce,” “we,” “us,” or “our”), 2459 Eastbluff Drive, Suite 842, Newport Beach, California 92660. If you use the Site, you agree to these Terms. If you do not agree, please do not use the Site. If you use the Site for an organization, you confirm you have authority to accept these Terms for it.

1. What Smart4ce does

Smart4ce is an automotive recruiting firm. Dealerships engage us to help fill roles. Our services for dealerships are governed by separate written agreements. These Terms cover only your use of the Site.

2. No promise of a result

The Site provides general information. Nothing on the Site promises that we will review your résumé, contact you, present you to a dealership, arrange an interview, or help you obtain an offer or employment. Hiring decisions are made by dealerships. Nothing on the Site creates an employment relationship with Smart4ce or a dealership, or an offer of employment.

3. Candidates: current status

The Site is not currently accepting résumé submissions. Please do not send résumés or other candidate information through the Site or by email in response to a Site prompt until we announce that intake has reopened.

When candidate intake reopens, our Candidate Notice and authorization forms will govern how we handle candidate information. Submitting information to us does not authorize us to present you to a dealership. We do that only if you approve a specific opportunity.

Please do not send Social Security numbers, government ID numbers, financial account information, passwords, medical information, or your current or past pay through the Site.

4. Marketing communications

Using the Site is not consent to receive marketing email or text messages. We do not currently offer a public email-subscription or text-message enrollment through the Site. If that changes, we will ask for separate permission and update these Terms and our Privacy Policy before activation.

5. Privacy

Our Privacy Policy explains how we handle personal information. It is part of these Terms only to the extent it describes how we handle information collected through the Site.

6. Acceptable use

You may use the Site only for lawful purposes. You may not attempt unauthorized access to the Site or our systems; interfere with the Site’s operation or security; introduce malicious code; use automated tools to scrape the Site in a way that burdens it; impersonate another person; or submit information you have no right to provide.

7. Our content

The Site’s text, graphics, logos, and other content are owned by Smart4ce or used with permission and are protected by law. You may view the Site and print or share pages for personal or ordinary business use. You may not copy, republish, modify, or use our content or marks in a way that suggests we endorse you or your products, without our written permission.

8. Information you send us

If you send us information through a form or email, you promise that you have the right to send it and that it is accurate to the best of your knowledge. What we do with it is described in our Privacy Policy.

9. Third-party links

The Site may link to other companies’ websites. Those companies control their own content, terms, and privacy practices. A link does not mean we endorse the third party, and we are not responsible for it. Third-party content does not load on this Site merely because a link is displayed; it loads only if you choose to follow the link.

10. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent the law permits, we disclaim warranties of any kind, including warranties about availability, accuracy, completeness, and fitness for a particular purpose. The Site is general information and is not legal, employment, financial, or other professional advice.

11. Limits on liability

To the fullest extent the law permits, Smart4ce and its owners, employees, and providers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or opportunities, arising from your use of, or inability to use, the Site. Our total liability for any claim about the Site is limited to $100. Nothing in these Terms limits liability that cannot be limited by law, including liability for fraud, willful injury, gross negligence, or violation of law.

12. Changes

We may change, pause, or end the Site at any time. We may update these Terms by posting a revised version with a new effective date. Changes apply from that date forward. Continued use after that date means you accept the revised Terms.

13. Accessibility

We want the Site to be usable by everyone. If you have trouble using any part of it, please email business@smart4ce.com or call 866-528-3014 and tell us how to reach you and what format you need.

14. Governing law and disputes

These Terms are governed by California law, without regard to conflict-of-law rules. Any dispute about the Site or these Terms will be brought in the state or federal courts located in Orange County, California, and you and Smart4ce consent to those courts’ jurisdiction.

15. California notice
